Agreement to Terms

By accessing and using the services of Kituyi General Contractors Limited, you accept and agree to be bound by the terms and provisions of this agreement. If you do not agree to abide by the above, please do not use our services.

Services Description

Kituyi General Contractors Limited provides comprehensive construction services including:

• Residential construction and development
• Commercial building projects
• Infrastructure development
• Renovation and remodeling services
• Project management and consultation
• Design and planning services

All services are subject to availability, our professional assessment, and the terms outlined in individual project contracts.

Payment Terms

Payment terms will be specified in individual project contracts and may include:

• Consultation fees: Due upon booking and confirmation
• Project deposits: Required before commencement of work
• Milestone payments: Based on project completion stages
• Final payment: Due upon project completion and approval

All payments must be made in the currency specified in the contract. Late payment charges may apply as outlined in individual agreements.

Project Scope and Changes

The scope of work for each project is clearly defined in written contracts. Any changes to the original scope must be:

• Requested in writing
• Approved by both parties
• Documented in a change order
• May result in additional costs and timeline adjustments

Warranties and Quality Assurance

We provide comprehensive warranties on our construction work:

• Structural work: 10-year warranty against defects
• Finishing work: 2-year warranty on workmanship
• Materials: Manufacturer warranties apply
• Maintenance services: Available during warranty period

Limitation of Liability

Our liability is limited to the total value of services provided under the specific contract. We are not liable for:

• Indirect, incidental, or consequential damages
• Loss of profits or business opportunities
• Delays caused by weather, permit issues, or force majeure events
• Defects in materials not supplied by us

Intellectual Property

All designs, plans, drawings, and creative work produced by Kituyi General Contractors Limited remain our intellectual property until full payment is received. Upon full payment, clients receive a license to use the designs for the specific project only.

Safety and Compliance

We are committed to maintaining the highest safety standards and legal compliance:

• All work complies with Kenyan building codes and regulations
• We maintain comprehensive insurance coverage
• Safety protocols are enforced on all job sites
• Proper permits are obtained before commencing work

Termination

Either party may terminate services under the following conditions:

• Written notice as specified in the contract
• Breach of contract by either party
• Non-payment of agreed fees
• Impossibility of performance due to unforeseen circumstances

Termination procedures and fees are outlined in individual project contracts.

Dispute Resolution

In the event of disputes, we encourage resolution through:

• Direct communication and negotiation
• Mediation through agreed third parties
• Arbitration if specified in the contract
• Legal proceedings as a last resort

Governing Law

These terms are governed by the laws of Kenya. Any legal disputes will be resolved through the appropriate courts in Nairobi, Kenya.

Privacy and Data Protection

We respect your privacy and handle personal information in accordance with our Privacy Policy and applicable data protection laws. Client information is kept confidential and used only for project-related purposes.

Last Updated: January 2024. We reserve the right to update these terms as necessary. Clients will be notified of significant changes that affect existing contracts.
